RICHMOND | A bill to outlaw using a cell phone while driving unless it’s a hands-free device hit a snag on the Senate floor Wednesday.
Instead of a final Senate vote on SB874, the legislation was referred to the Courts of Justice Committee.
Sen. Ken Stolle, R-Virginia Beach, called for the bill to be rerouted, citing unresolved “legal issues that need to be addressed.”
Sen. Patricia Ticer, D-Alexandria, the bill’s sponsor, remains hopeful it will become law. “You simply cannot hold onto the steering wheel of a car if you are talking on a cell phone that has to be held with a hand,” she said.

Bill on alcohol, guns advances
A bill to prohibit individuals with concealed weapons permits from drinking alcohol in restaurants advanced out of a Senate Courts of Justice committee Wednesday in a 9-6 vote.
HB1035, sponsored by Sen. Emmett Hanger, R-Augusta County, would also require people carrying concealed weapons into restaurants to alert a manager at the establishment that they have a firearm.
If passed into law, the measure would have one penalty for people who imbibe alcohol at a restaurant while carrying a firearm and a stiffer one for those who become intoxicated.
The legislation passed both chambers of the General Assembly last year, but was vetoed by Gov. Timothy M. Kaine.

Jim and Melody Cunningham’s 35th anniversary

Jim and Melody Cunningham are celebrating their 35th wedding anniversary. Jim and Melody grew up as neighbors in the South Park neighborhood and were married on June 27, 1975, in a ceremony conducted by the Rev. Houston.
Jim runs his own business , J.C. Drywall and Construction, and enjoys his farm out in the Tyhee area. Melody is a senior inspector at the Inkom Port of Entry and enjoys gardening, hosting many family get-togethers , and scuba-diving.
Jim and Melody both love the outdoors, traveling and above all, spending time with family… especially their 2-yearold granddaughter, Averie. She loves to ride the “wheeler” with Grandpa and to cook with Grandma.
Some of their favorite traveling destinations have been a cruise in the Western Caribbean, Alaska, Mexico, and most recently, Moab, Utah.
They are the parents of three children, Conar Cunningham, who is a police officer in Sun Valley, Idaho, Leslie Cunningham, who is a second-grade teacher in Pocatello, and Nolan Cunningham , who is in partnership with Jim in their business, J.C. Drywall and Construction.
Everyone who knows this wonderful couple knows how dedicated they are to each other and their family. They are a wonderful example of what true love really is and what wonderful things can become all because two people fell in love.
The couple resides in the home they built together 21 years ago and have chosen to celebrate this special event by going on a romantic getaway.

Supervisor failed diver in his care

A scuba diver tragically drowned in the Pacific Ocean after an instructor failed to keep an eye on her, a coroner has said.
Donna Newton, from Street, Somerset, was diving off the Galapagos Islands, in Ecuador, in October last year but got into difficulty and was unable to get to the surface.
An inquest into her death took place in Maidstone, Kent, last week and the coroner has now published a narrative verdict.
Roger Sykes, Mid Kent and Medway coroner, said: “Donna Newton died from drowning on a dive on October 6, 2009, off Isabela Island, Galapagos Islands, Ecuador.
“Her dive master failed to keep watch over her and her dive buddy.
“Her dive buddy failed to signal to Donna and the dive master that she had to ascend early, and the dive master failed to notice that Donna had a loss of buoyancy control on her ascent, probably caused by vomiting into her mask and mouth piece.
“These were serious failures to conform to recognised diving practices.”
The inquest heard Miss Newton, an experienced diver who worked for Thales in Wells, had joined others aboard the MV Sky Dancer, a 16-passenger yacht, on October 4. That night and the following day she was vomiting, ascribed to food poisoning.
The senior dive master for the group was Fabricio Carbo, a very experienced guide holding the second highest rank as a diving instructor in his country.
Mr Carbo did not accompany the divers on their check-out dive to ascertain their competency and the rate at which they consumed air underwater.
At about 11.30am on October 6, Miss Newton commenced a dive off Isabela Island with a dive buddy under the supervision of Mr Carbo as dive master.
Her dive buddy ascended early without signalling her intention to do so either to her buddy or the dive master.
Mr Sykes said: “It is recognised diving practice that divers should be paired with someone who has a similar diving pattern and that the pair of buddies should keep a watchful eye on each other and signal to the other when they need to ascend.
“It is also recognised diving practice that the dive master should keep a watch over all the divers in his group and, in the event that a buddy has to ascend, should pair up the remaining diver with a new buddy. The dive master should be aware at all times of the whereabouts of the divers in his group.”
Later, when the divers ascended to the surface and were counted, Mr Carbo realised Miss Newton was missing and a search ensued. Nobody had been aware that she had any problems during the dive, but she was found floating on her back with no signs of life.
Her mask was off and there was blood and vomit around her nose.
Her buoyancy jacket had been inflated and she had operated her emergency location beacon.
A post-mortem examination showed that she had died from immersion.
An analysis of her personal diving computer showed no abnormal diving pattern on any of her previous 51 dives.
Mr Sykes concludes: “I find on the balance of probabilities that she had been distracted on her ascent by a bout of vomiting, which required her to remove the mouth piece to her breathing apparatus and her mask to wash away the vomit, and that she thereby got into difficulties and drowned.”
